Please read these Terms and Conditions carefully before placing an order with PawT's. By accessing our website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

1. About PawT's

PawT's is a South African custom pet apparel business that creates personalised artwork based on customer-submitted pet photographs and prints that artwork onto garments including t-shirts, hoodies, sweaters, and hats. PawT's operates online and delivers orders to Pudo lockers across South Africa.

These Terms and Conditions are governed by the laws of the Republic of South Africa, including but not limited to the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act"), and the Protection of Personal Information Act 4 of 2013 ("POPIA").

2. Eligibility

By placing an order with PawT's, you confirm that:

  • You are at least 18 years of age, or are placing the order with the consent and supervision of a parent or legal guardian
  • You are located in South Africa or are placing the order for delivery to a South African Pudo locker
  • You have the legal right to submit the pet photograph(s) provided with your order
  • All information provided during checkout is accurate and complete

3. Orders & the Custom Order Process

3.1 Placing an Order

All orders are placed through our website. By submitting an order, you are making an offer to purchase the selected product(s) at the listed price. Your order is confirmed once you have received an order confirmation email from PawT's and payment has been successfully processed via Paystack.

3.2 The Custom Production Process

Once your order is confirmed and your pet photo has been received and approved, PawT's will:

  • Create a custom digital artwork based on your submitted photograph
  • Print the approved artwork onto your selected garment(s)
  • Package and dispatch your order to your chosen Pudo locker

Production typically begins within 24 to 48 hours of order confirmation and photo approval. Estimated turnaround times are communicated on the website and via order confirmation emails. These are estimates and may vary during busy periods.

3.3 Photo Requirements

The quality of your artwork is directly dependent on the photo you submit. PawT's requires:

  • A clear, well-lit, high-resolution photograph of your pet
  • The pet's face to be clearly visible and in focus
  • No watermarks, excessive filters, or heavy cropping

If your submitted photo does not meet our quality requirements, we will contact you to request a replacement. If no suitable photo is provided within 5 (five) business days of our request, PawT's reserves the right to cancel the order and issue a full refund.

3.4 Artwork Approval

Where PawT's offers an artwork preview before printing, you will be notified to review and approve the artwork. Once you approve the artwork, production proceeds and the order is considered final. PawT's is not responsible for errors that were present in an approved artwork proof.

4. Pricing & Payment

4.1 Pricing

All prices displayed on the PawT's website are in South African Rand (ZAR) and are inclusive of VAT where applicable. PawT's reserves the right to update pricing at any time. The price applicable to your order is the price displayed at the time of checkout.

4.2 Payment

All payments are processed securely via Paystack. PawT's accepts the payment methods made available through the Paystack platform, which may include credit/debit cards and EFT. PawT's does not store your card or banking details.

Your order will only proceed to production once full payment has been received and confirmed. In the event of a failed or incomplete payment, your order will not be processed.

5. Delivery & Pudo Lockers

PawT's delivers exclusively to Pudo lockers across South Africa. By placing an order, you agree to the following:

  • You are responsible for selecting the correct Pudo locker at checkout
  • You will collect your parcel within the timeframe specified by Pudo upon receiving your collection notification
  • PawT's is not liable for parcels that expire at a Pudo locker due to non-collection
  • If a parcel is returned to PawT's due to non-collection, a re-delivery fee may apply before the parcel is re-dispatched
  • Delivery timeframes are estimates and PawT's is not liable for delays caused by Pudo or third-party courier partners

6. Intellectual Property

6.1 PawT's Artwork

All artwork created by PawT's, including digital illustrations and printed designs, is the original creative work of PawT's. Unless otherwise agreed in writing, all intellectual property rights in the artwork remain with PawT's. By purchasing a product, you receive a licence to use the artwork on the physical garment for personal, non-commercial use only.

You may not reproduce, distribute, sell, or use the artwork for any commercial purpose without prior written consent from PawT's.

6.2 Customer-Submitted Photographs

By submitting a photograph with your order, you confirm that:

  • You are the owner of the photograph or have the right to use and submit it
  • You grant PawT's a non-exclusive, royalty-free licence to use the photograph solely for the purpose of creating your custom artwork and fulfilling your order
  • You grant PawT's permission to use the final artwork (not the original photo) for marketing purposes, including on our website, social media, and portfolio, unless you specifically request otherwise in writing at the time of ordering

7. Prohibited Uses

When using the PawT's website and services, you agree not to:

  • Submit photographs that contain nudity, explicit content, hate symbols, or any unlawful material
  • Impersonate any person or misrepresent your identity
  • Use our website for any unlawful purpose or in violation of any applicable South African laws
  • Attempt to gain unauthorised access to our website, payment systems, or customer data
  • Copy, scrape, or reproduce any content from our website without permission

8. Limitation of Liability

To the fullest extent permitted by South African law:

  • PawT's is not liable for indirect, incidental, or consequential damages arising from the use of our products or services
  • Our liability to you in connection with any order shall not exceed the total amount paid by you for that specific order
  • PawT's is not responsible for loss or damage caused by events outside our reasonable control, including courier delays, locker unavailability, or force majeure events

Nothing in this section limits your rights under the Consumer Protection Act or any other applicable legislation.

9. Warranties & Product Quality

PawT's warrants that all products are:

  • Produced with reasonable care and skill
  • Suitable for the purpose of wearing as garments
  • Free from manufacturing defects at the time of dispatch

PawT's makes no warranty as to the exact visual outcome of artworks, as this is a creative and interpretive process. However, all artworks will be based on the submitted photograph and produced in the artistic style displayed in our Gallery.

For garment care, please follow the care label instructions on your product to preserve print quality. PawT's is not responsible for damage resulting from improper washing or care.

10. Cancellations & Refunds

Cancellations and refunds are governed by our Refund and Returns Policy, which forms part of these Terms and Conditions. In summary:

  • Orders may be cancelled before production commences for a full refund
  • Custom-made products cannot be returned or refunded on the basis of change of mind
  • Defective or incorrect items will be replaced or refunded in accordance with the CPA

11. Privacy & Personal Information

PawT's collects and processes personal information in accordance with our Privacy Policy and in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA).

12. Website Use & Electronic Communications

In accordance with the Electronic Communications and Transactions Act 25 of 2002:

  • Our website constitutes an electronic marketplace and these Terms and Conditions constitute a binding electronic agreement
  • Order confirmations and communications sent via email constitute valid written records of transactions
  • PawT's reserves the right to update, modify, or discontinue the website or any part thereof at any time without notice

13. Dispute Resolution

In the event of a dispute arising from these Terms and Conditions or any order placed with PawT's, the parties agree to first attempt to resolve the matter amicably by contacting PawT's directly.

These Terms and Conditions are governed by the laws of the Republic of South Africa and any legal proceedings shall be subject to the jurisdiction of the South African courts.

14. Changes to These Terms

PawT's reserves the right to update or amend these Terms and Conditions at any time. The updated version will be published on our website with a revised effective date. Continued use of our website or services after any changes constitutes your acceptance of the updated Terms and Conditions.
